1.    About Us

1.1. We are CHF Decluttering Limited, a company registered in England and Wales with company number 16456520 and our registered office is at Suite 307 Boundary House, Boston Road, London, England, W7 2QE.

2.    Basis of Sale

2.1. These terms and conditions (Contract) apply to the exclusion of any other terms that the customer seeks to impose or incorporate. To the maximum extent permitted by law, no terms are implied into the Contract by law, trade custom, practice or course of dealing.

2.2. Please indicate acceptance of these terms and conditions by ticking the box at the time of booking (the terms and conditions will always be available on the website should you require a copy of them).

3.    Supply of Services

3.1. CHF Decluttering provides professional decluttering services for your home and office as detailed on the website: www.chfdecuttering.co.uk (Services).

3.2. The initial introductory virtual call is free and 20 minutes long. Thereafter, if you wish to engage with CHF Decluttering’s Services, you can select a package that makes sense to you.

3.3. A 50% deposit is payable at the time of the session booking.

3.4. CHF Decluttering will provide the Services using reasonable care and skill and will always give advice in good faith.

3.5. However, it will always remain your decision as to whether or not you accept the guidance given as well as whether or not you donate, recycle, repair or dispose of specific items. Please note that CHF Decluttering will not accept responsibility for the consequences of the decision. 

3.6. Occasions may arise where you possess high value items, and therefore you must acknowledge that those employed by CHF Decluttering are not qualified valuers, should the need arise to value items for insurance purposes.

4.    Working Hours Including Breaks

4.1. Bookings will be based on an agreed prearranged number of hours, and an upfront 50% deposit will be taken at the time the booking is made.

4.2. CHF Decluttering will confirm the booking via a booking confirmation email. 

4.3. Due to the nature of the Services provided, it is impossible to accurately calculate the hours required for the job.

4.4. Work is carried out in 1-hour, 3-hour and 6-hour sessions across weekdays, weekends and bank holidays between the core hours of 10am-4pm.

4.5. Hours charged will be based on actual hours worked.

4.6. The hourly rate starts from £80 per hour for a 6-hour session on a weekday.

4.7. Additional hours outside of the core hours mentioned above will be charged starting from £160 an hour.

4.8. Short breaks are required and will be included within the booked session. 

4.9. These short breaks may include toilet breaks, water breaks and rest breaks.

4.10. 3-hour sessions will include a 15 minute  break for rest.

4.11. 6-hour sessions will include a 30 minute  break for lunch.

5.    Limits of Work Including Removal of Items

5.1. CHF Decluttering endeavours to help you achieve your desired clutter free space.

5.2. CHF Decluttering is not a professional cleaning company, therefore, a very light cleaning service can be provided.

5.3. CHF Decluttering is not a professional removals company, advice will be provided. Relocation of some items will not be possible where heavy lifting or moving is involved, e.g. a washing machine, a fridge/freezer, heavy furniture. However, CHF Decluttering can assist with arranging collections of items to be donated, recycled or disposed of.

5.4. If access to desired areas are unsafe to reach, e.g. lofts, garages and sheds, these areas might require additional service providers and you must cover the additional charges directly with the additional service provider.

5.5. When it comes to the removal of items from your premises, this will require your authorisation.

5.6. CHF Decluttering can help you with for example: arranging skip hire, charity collections and local council collections. However, any additional costs will need to be invoiced directly to you and paid by you.

6.    Customer’s Obligations

         6.1. The customer shall:

(a) provide CHF Decluttering with such information and assistance as CHF Decluttering may reasonably require to supply the Services, and ensure that the information is and remains complete and accurate in all material respects;

(b) provide clear access to the customers premises and toilet during each decluttering visit;

(c) ensure that its premises are kept safe and ventilated during each decluttering visit;

(d) secure or remove fragile or irreplaceable items before each decluttering visit;

(e) pay the outstanding amount due once the booked session has ended.

6.2. CHF Decluttering shall not be liable if it is prevented or delayed in delivering the Services due to any action or inaction of the customer (Customer Default).

6.3. The customer shall reimburse CHF Decluttering on written demand for any costs or losses sustained or incurred by CHF Decluttering arising directly or indirectly from the Customer Default.

7.    Travel

7.1. CHF Decluttering is based in the Borough of Dacorum (Hertfordshire) and serves customers in Hertfordshire, Bedfordshire, Buckinghamshire, London and beyond.

7.2. Mileage is complimentary within the Borough of Dacorum.

7.3. Business mileage will be charged at 45p per mile for the first 10,000 miles, and 25p per mile thereafter in line with gov.uk for customers living outside of the Borough of Dacorum.

7.4. If there is no off road or free parking, the customer will cover the parking costs.

7.5. Tolls will be an additional charge to the customer if applicable to complete the service e.g. London’s Congestion, M6 tolls, Dartford Crossing, etc.

7.6. For any decluttering customers living outside of the areas mentioned above, aspects such as distance, accommodation, travel time and expenses may all be included in the invoice as additional charges.

8.    Payment Terms including Discounts and Pay Forward

8.1. CHF Decluttering will issue you an invoice at the end of the session which is payable at completion of the session.

8.2. You can pay in cash or via bank transfer.

8.3. Overtime occurs when the session booked has elapsed, it is calculated by the hour and is charged at double the hourly rate of the session booked.

8.4. All amounts due shall be paid in full without any set-off, counterclaim, deduction or withholding.

8.5. CHF Decluttering has implemented a Pay Forward model whereby customers who wish to donate additional funds at the time of booking or at the time of payment can do so. These additional funds will be offered to those less financially able in order for them to access CHF Decluttering’s services as and when the funds received meet the cost of a full day (6 hour) session.

8.6. Where a discount, early bird perk, competition, Pay Forward session, etc are awarded and advertised, subject to availability, each customer cannot use more than one code per calendar year.

8.7. If the customer fails to make a payment due to CHF Decluttering under the Contract by the due date, then, without limiting any other remedies available to CHF Decluttering, the customer shall pay interest on the overdue sum from the due date until payment of the overdue sum, whether before or after judgment. Interest under this clause 8.7 will accrue each day at 4% a year above the Bank of England's base rate from time to time, but at 4% a year for any period when that base rate is below 0%.

9.    Cancellation

9.1. CHF Decluttering has the right to cancel the Contract due to unforeseen circumstances, and will try to reschedule as soon as is possible or give a full refund of the deposit paid.

9.2. The customer has the right to cancel the Contract due to unforeseen circumstances. However, any expenses paid in advance, including travel for which full refunds cannot be obtained will not be refundable in any circumstances that result in you being invoiced at the time of cancellation.

9.3. If you cancel up to 72 hours before the start of the session, you will be charged 25% of the entire session fee.

9.4. If you cancel up to 48 hours before the start of the session, you will be charged 50% of the entire session fee.

9.5. If you cancel within 24 hours of the start of the session, you will be charged 100% of the entire session fee.

9.6. The cancellation charge for postponing a cancelled session may be waivered at the discretion of CHF Decluttering.

10.  Confidentiality & Privacy

10.1. Each party shall comply, and provide reasonable assistance to the other party to comply, all applicable legislation and regulatory requirements in force from time to time in the UK relating to the use of personal data and the privacy of electronic communications, including (i) the Data Protection Act 2018, (ii) the UK GDPR, and (iii) the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) in connection with the performance of the contract.

10.2. CHF Decluttering has registered with the ICO (Information Commissioner’s Office).

11.  Photographs & Social Media

11.1. CHF Decluttering will take before, during, and after photos and videos throughout the session for a variety of reasons.

11.2. First and foremost, the photos and videos will serve as a reference point for you to remind yourself of how the space was versus how the space is now.

11.3. The photos and videos will help analyse the space you have and any storage requirements.

11.4. With your permission, these photos and videos will be used on CHF Decluttering’s social media accounts and/or website. You will never be tagged in these posts. The posts will be anonymised and will not compromise your privacy data including, but not limited to your name, location, and family photos contained within the photos and videos.

11.5. The content on our website and social media platforms will assist future customers to make a more informed decision as to whether or not engaging with CHF Decluttering is the right decluttering service provider for them.

12.  Associations & Memberships

12.1. CHF Decluttering has employees who are pending their accreditation from Declutter Dollies (Dilly Carter from BBC 1’s Sort Your Life Out).

12.2. CHF Decluttering is in the process of applying to be a member of APDO UK (The Association of Professional Declutterers and Organisers) and abides by their Code of Ethics: https://www.apdo.co.uk/code-of-ethics/

12.3. CHF Decluttering has employees who are members of the global professional accounting body ACCA (Association of Chartered Certified Accountants).

12.4. CHF Decluttering has employees with Basic DBS checks (Disclosure and Barring Service).

12.5. CHF Decluttering has registered with the Environment Agency as an upper tier waste carrier, broker and dealer in order to assist with removal of items.

13.  Limitation of Liability

13.1. Those employed by CHF Decluttering carrying out your personalised decluttering service hold Professional Indemnity cover up to £250,000 and Public Liability cover up to £5,000,000.

13.2. Whilst we endeavour to always handle your possessions with care, accidents may occur.

13.3. CHF Decluttering will not be liable for any damages or losses incurred, therefore, we ask that you have appropriate insurance cover to compensate you accordingly.

13.4. Nothing in the Contract limits or excludes any liability which cannot legally be limited or excluded, including liability for: (a) death or personal injury caused by negligence; and (b) fraud or fraudulent misrepresentation.

13.5. Subject to the preceding paragraph, each party’s total liability shall not exceed 100% of the charges for the Services. All indirect and consequential losses (including loss of profits) are excluded.

14.  General

14.1. Neither party shall be in breach of the Contract or otherwise liable for any failure or delay in the performance of its obligations if such delay or failure results from events, circumstances or causes beyond its reasonable control.

14.2. If any provision of these terms and conditions is or becomes invalid, illegal or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of the terms and conditions.

14.3. The Contract shall be governed by the laws of England and Wales and the parties agree to the exclusive jurisdiction of the courts of England and Wales.
